The Court of Appeal judge , Justice Hannah Okwengu was the the fifth one from the bench of the learned minds to deliver her judgement.
The judge did that after Justice Kiage did his thing in a way that left a good number of kenyans admiring him.
Justice Okwengu pointed out, in her judgement the mistakes that were in the Building Bridges Initiative Process.
The first one was public participation, according to her, there was no evidence that there was a meaningful public participation exercise hence finding the BBI process to be constitutionally unsustainable.According to Article 257 of our constitution, a popular initiative is a process that begins by the people and not by their representatives or the government.
Secondly,the BBI taskforce and steering committee were appointed to advise the president on matters within his governance and mandate and he was free to receive proposals for amending the Constitution through the parliamentary process but not under Article 257.
